Timing that matters
Complaints to OCR should generally be filed within 180 days of the problem.

- 130 days is the standard deadline; one 30-day extension requires a written reason.
- 2Fees must be reasonable and cost-based — labor for copying, supplies, and postage.
- 3You cannot be charged a search or retrieval fee for access to your own record.
- 4Records cannot be withheld because of an unpaid medical bill.
- 5If you are refused or over-charged, file with HHS Office for Civil Rights.
Before you move on
Write down who you spoke with, the date, and what they promised. A short dated note is the single most useful thing you can have if this issue has to be escalated later.
